Victory for Workers’ Rights: Kenya Airways Withdraws Lawsuit Against KALPA Union Leader 

In a landmark development for labour rights in Kenya’s aviation sector, the Employment and Labour Relations Court (ELRC) sitting in Nakuru has witnessed a significant outcome in the long-running dispute between Kenya Airways (KQ) and the Kenya Airline Pilots Association (KALPA). 

Following proceedings before the court, Kenya Airways formally withdrew its suit that sought to hold a senior KALPA union leader criminally liable for his role in organising and leading the historic pilots’ strike of 2022. 

This withdrawal marks a major win for trade unionism and protections afforded to workers exercising their constitutional rights to organise, bargain collectively, and where necessary engage in protected industrial action. It reaffirms that union officials cannot be unduly penalised through civil or criminal proceedings simply for discharging their duties in representing members’ interests.

Background to the Dispute 

The 2022 industrial action by KALPA members brought national attention to longstanding grievances among Kenya Airways pilots, including pay structures, working conditions, pension contributions, and deferred salary payments. The four-day strike grounded dozens of flights, affected thousands of passengers, and highlighted deep tensions in one of East Africa’s flagship carriers. 

While the courts at the time declared aspects of the strike unprotected, the subsequent years saw prolonged litigation initiated by the airline against union leadership. Many in the legal and labour community viewed these proceedings as an attempt at retaliation rather than legitimate redress.

The Turning Point in Nakuru 

On the day the matter was listed for directions/hearing at the ELRC Nakuru, Kenya Airways through its legal team elected to withdraw the entire claim. The withdrawal was placed on record, effectively bringing the matter to a close without any adverse findings against the union leader or KALPA.

Moments after the ruling was noted, our team, led by Senior Partner Levi Munyeri, joined jubilant KALPA representatives and supporters outside the Nakuru Law Courts celebrating in the mood of vindication and solidarity.

Senior Partner Levi Munyeri, who has represented the union leader throughout these proceedings, commented: 

“This is more than the withdrawal of one lawsuit – it is a reaffirmation of the constitutional space that trade unions occupy in our democracy. Workers must be free to advocate for fair treatment without fear of reprisal. We are proud to have stood with KALPA and its leadership through every stage of this battle.”
